What Is DWI in New Mexico?

Driving While Intoxicated (DWI) refers to operating a vehicle with a blood alcohol concentration (BAC) of 0.08% or higher for drivers aged 21 and over. The limit for commercial drivers is 0.04%, while for drivers under 21, the threshold is set at 0.02%. The state also penalizes drivers for being impaired by drugs, whether prescription, over-the-counter, or illegal substances.

While the legal limits are set as above, you can be arrested for DWI even if your BAC is below the legal limit if the prosecution can show that your driving was impaired to any degree.

What Is the Difference Between DWI & DUI?
